A California couple has taken legal action against a group of medical professionals and a hospital, alleging negligence that led to significant personal injury. Duane Harcrow and Lisa Harcrow filed their complaint in the Superior Court of California, County of Sacramento, on November 27, 2024, naming Allen S. Morris, M.D., Ronald G. Jan, M.D., Christopher Hart, P.A., and Sutter Valley Hospitals doing business as Sutter Medical Center Sacramento as defendants.
The lawsuit centers around allegations of medical negligence that purportedly began on December 15, 2023. According to the complaint, Duane Harcrow sought medical treatment from the defendants for unspecified needs. The plaintiffs assert that the defendants agreed to provide care but failed to meet the standard level of skill and diligence expected from medical practitioners in Sacramento County. "Defendants...failed to exercise the degree of due care and/or skill and/or learning common to other medical practitioners," states the complaint.
The alleged negligence reportedly resulted in serious injuries for Duane Harcrow, affecting his health and causing profound shock and injury to his nervous system. The complaint details how these injuries have led to permanent disability and ongoing pain and suffering for Mr. Harcrow. Additionally, it claims that he will incur future medical expenses and has already suffered loss of earnings due to his inability to work.
Lisa Harcrow's claim is based on loss of consortium due to her husband's injuries. She alleges that as a result of the defendants' actions, she has been deprived of her husband's companionship and support. The couple is seeking general damages exceeding the court's minimum jurisdictional amount for both physical injuries and emotional distress caused by this alleged negligence.
In their prayer for relief, the plaintiffs are asking for general damages related to personal injury, special damages covering past and future medical expenses as well as lost earnings, damages for loss of consortium claimed by Lisa Harcrow, interest on all damages incurred at lawful rates prior to judgment, costs associated with bringing the suit forward, and any additional relief deemed appropriate by the court.
Representing Duane and Lisa Harcrow is attorney Blair H. Widders from Wilcoxen Callaham LLP. The case is being overseen by Judge P. Russell Dapauty under Case No. 2 402." O24 So in the Superior Court of California.
