Plaintiffs accuse Waste Management Company Atlas Disposal Industries LLC of Negligence

A couple has taken legal action against a waste management company following a severe vehicle collision that resulted in significant personal injuries. On December 6, 2024, Wade Adams and Beth Adams filed a complaint in the Superior Court of California, County of Sacramento, against Atlas Disposal Industries, LLC, and its employee Jose Martin Fernandez.

The case stems from an incident on August 28, 2023, when Wade Adams was driving his Toyota Tacoma truck northbound on Grant Line Road in Sacramento County. According to the complaint, he was involved in a collision with a garbage truck owned by Atlas Disposal Industries and operated by Jose Martin Fernandez. The plaintiffs allege that Fernandez was acting within the scope of his employment at the time of the accident. They claim that the defendants were negligent in their operation and maintenance of the garbage truck, which led to the collision. The lawsuit cites violations of California Vehicle Code section 22350 among other statutes as evidence of negligence.

The Adamses are seeking compensation for various damages resulting from the accident. Wade Adams claims to have suffered severe physical injuries and mental distress due to the crash. He anticipates permanent disability and has already incurred substantial medical expenses for treatment. Additionally, he expects future medical costs as well as loss of income due to his inability to work following the accident. Beth Adams is also seeking damages for loss of consortium, asserting that her husband's injuries have deprived her of his companionship and support.

In their lawsuit, Wade and Beth Adams request general damages exceeding $25,000 for personal injuries and related losses. They also seek compensation for lost earnings, both past and future medical expenses, incidental costs related to the accident, depreciation in value or loss of use of their vehicle, interest on all claimed damages at lawful rates, and any further relief deemed appropriate by the court.
