Angel Bravo has filed a lawsuit against his former employer, MBKT Corp, doing business as Pacific Coast Home Services, alleging a series of labor law violations. The complaint was filed on December 9, 2024, in the Superior Court of California, County of Santa Clara. The case targets MBKT Corp and its managing agent Kim W. Hancock for alleged failures to pay wages and overtime, among other claims.
The lawsuit details how Angel Bravo accuses MBKT Corp of failing to pay daily overtime wages as required by California law. Bravo alleges that the company implemented an invalid "alternative workweek" system that was not properly established through a secret ballot election or registered with the State of California. As a result, workers were often made to work more than eight hours in a day without receiving appropriate overtime compensation. Additionally, Bravo claims that he and other employees were not compensated for all hours worked due to restrictions placed on their use of company vehicles outside work hours.
Bravo's complaint further alleges that MBKT Corp failed to provide accurate wage statements and did not reimburse necessary business expenses such as vehicle use fees deducted from workers' wages. These practices are said to constitute unfair competition under California’s Unfair Competition Law. Bravo seeks restitution for unpaid wages, penalties, liquidated damages, interest, attorneys’ fees, and costs associated with these violations.
The legal action also highlights potential civil penalties under the Private Attorneys General Act (PAGA), allowing Bravo to seek penalties on behalf of himself and other aggrieved employees for violations of the Labor Code. He aims to hold both MBKT Corp and Kim W. Hancock accountable for their roles in these alleged infractions.
