A couple in California is taking legal action against a major automobile manufacturer over alleged defects in their newly purchased vehicle. Julie Kim and Won Kim filed a complaint on December 9, 2024, in the Superior Court of California, County of Santa Clara, against Ford Motor Company. The lawsuit centers around a 2021 Ford Bronco Sport that the plaintiffs claim has numerous defects impairing its use, value, and safety.
According to the complaint, Julie and Won Kim allege that the vehicle they purchased for $48,005 was riddled with issues from impaired drivability to engine and transmission defects. They argue that these problems surfaced during the warranty period but were not adequately addressed by Ford or its authorized repair facilities despite multiple attempts to resolve them. The plaintiffs assert that these failures constitute breaches of both implied and express warranties under California's Song-Beverly Consumer Warranty Act.
The Kims' legal action highlights several causes of action against Ford Motor Company. They accuse the automaker of breaching implied warranties by selling an unmerchantable vehicle and failing to replace or repurchase it as required by law. Furthermore, they claim Ford did not commence repairs within a reasonable time frame nor complete them within 30 days as mandated by California Civil Code § 1793.2(b). The complaint also alleges that Ford failed to provide adequate service literature and replacement parts to its repair facilities during the warranty period.
The plaintiffs are seeking various forms of relief from the court. They demand damages including restitution for the purchase price or diminution in value due to defects, civil penalties up to twice their actual damages for willful violations of warranty obligations, consequential and incidental damages, as well as attorney fees and costs associated with the lawsuit. Additionally, they request prejudgment interest at the legal rate.
