A former employee has taken legal action against a dessert company, accusing it of widespread labor violations. On December 26, 2024, Noemi Miranda Gonzalez filed a complaint in the Superior Court of California, County of Sacramento, against Chalet Desserts, LLC and Chalet Desserts, Inc., alleging multiple breaches of the California Labor Code under the Private Attorneys General Act (PAGA).
The lawsuit details a series of grievances against Chalet Desserts. Gonzalez claims that the company failed to pay minimum and overtime wages properly, neglected to provide accurate wage statements, and did not reimburse necessary business expenses. The complaint alleges that these practices were part of a systemic issue affecting many employees. "Defendants jointly and severally acted intentionally and with deliberate indifference," Gonzalez asserts in her filing. She believes that her case is valid due to the numerous alleged violations including sections 201 through 204 concerning timely payment of wages during employment and upon termination.
Gonzalez seeks civil penalties for these alleged infractions under PAGA, which allows aggrieved employees to act as private attorneys general on behalf of themselves and other affected workers. She is asking for penalties that include $100 per aggrieved employee per pay period for initial violations and $200 for subsequent ones under various sections of the Labor Code. Additionally, she requests reimbursement for attorney fees and costs incurred during this legal battle.
