A California resident has taken legal action against a major automobile manufacturer, alleging significant breaches of warranty laws. Salamat Alshyn filed a complaint in the Superior Court of California, County of Santa Clara, on December 23, 2024, accusing General Motors LLC of failing to uphold express and implied warranties under the Song-Beverly Consumer Warranty Act.
The lawsuit centers around a 2020 Chevrolet Bolt purchased by Alshyn on November 20, 2020. The plaintiff claims that the vehicle suffered from defects and malfunctions that were not rectified despite multiple repair attempts. According to the complaint, these issues significantly impaired the car's use, value, and safety. Alshyn asserts that General Motors LLC did not fulfill its obligations under California's consumer protection laws by either repairing the vehicle within a reasonable timeframe or providing restitution or replacement as required by law.
Alshyn's complaint outlines two primary causes of action: breach of express warranties and breach of implied warranty under the Song-Beverly Consumer Warranty Act. The plaintiff alleges that General Motors LLC knowingly failed to comply with these legal duties, citing specific sections of the California Civil Code. "Defendants violated the Song-Beverly Consumer Warranty Act by failing to conform the Vehicle to the express written warranties within a reasonable number of repair attempts," states the complaint.
In addition to seeking actual damages estimated at $21,000 for the purchase price of the vehicle, Alshyn is requesting civil penalties amounting to twice this figure due to what is described as willful non-compliance by General Motors LLC. The plaintiff also seeks restitution for all payments made towards acquiring the vehicle and coverage for incidental and consequential damages incurred due to its defects.
Furthermore, Alshyn is pursuing attorney’s fees and costs associated with bringing this action forward. The complaint also calls for declaratory relief rescinding the sales contract and demands an injunction against further unfair business practices by General Motors LLC as defined under California Business & Professions Code §§ 17200 et seq.
