Chiropractic Patient Alleges Negligence Against Local Chiropractor Over Outdated Equipment

In a gripping legal battle, two residents of Santa Clara County have filed a lawsuit against a local chiropractor and his health center, alleging severe misconduct and negligence. The complaint was filed by Zsuzsanna Mester and her husband Jushaun Davis on January 2, 2025, in the Superior Court of California, County of Santa Clara, targeting Austin Jones, D.C., and Momentum Chiropractic Health Center.

The plaintiffs accuse Austin Jones and his chiropractic facility of multiple counts of medical negligence, negligent misrepresentation, concealment, and loss of consortium. The case dates back to March 9, 2020, when Ms. Mester first sought chiropractic care from Jones. She alleges that during her treatment over the years, Jones used outdated equipment for spinal decompression therapy while falsely claiming it was "state of the art." This misrepresentation is said to have led Ms. Mester to undergo unnecessary procedures that resulted in significant physical and emotional distress.

Ms. Mester's ordeal intensified after a follow-up visit on May 19, 2022. Despite the passage of more than two years since her initial consultation, Jones allegedly continued to rely on outdated x-rays instead of ordering new ones. This oversight is part of what the plaintiffs describe as a broader pattern of negligence where Jones failed to provide adequate follow-up care or respond to patient concerns effectively.

In their detailed complaint, the plaintiffs assert that Jones not only misrepresented the quality of his equipment but also concealed crucial medical information from Ms. Mester. They argue that these actions were intended to deceive her into agreeing to treatments without fully understanding the risks involved. The couple claims this deceitful conduct has caused them substantial harm—both physically for Ms. Mester and emotionally for Mr. Davis due to the impact on their marital relationship.

The lawsuit seeks various forms of relief from the court including general damages for pain and suffering experienced by Ms. Mester; special damages covering past and future medical expenses; punitive damages aimed at punishing Jones for his alleged misconduct; as well as attorneys’ fees and costs associated with bringing forth this legal action.
