Monica Lujan has taken legal action against a major retail corporation, alleging widespread wage and labor violations. On January 6, 2025, Lujan filed a class-action lawsuit in the Superior Court of California, County of Santa Clara, accusing Home Depot USA, Inc. of several infractions including failure to pay minimum and overtime wages, and not providing mandatory meal breaks.

The complaint outlines that Home Depot has allegedly engaged in practices that require non-exempt employees to perform tasks off-the-clock without proper compensation. This includes time spent waiting at the beginning or end of shifts and a practice known as "rounding," where employees' recorded work hours are adjusted to fit scheduled shifts rather than actual hours worked. Monica Lujan, who has been employed by Home Depot in various roles including as a merchandiser at their Gilroy location, claims these practices have resulted in significant unpaid wages for herself and other similarly situated employees across California.

Lujan's lawsuit further accuses Home Depot of failing to provide timely meal and rest breaks as required by California law. She alleges that employees were often under the control of the employer during these times but were not compensated accordingly. Additionally, she asserts that the company failed to furnish accurate wage statements, which is a violation of state labor codes.

The plaintiff seeks multiple forms of relief from the court on behalf of herself and other affected employees. These include back pay for unpaid wages, statutory penalties for each violation of labor laws, restitutionary disgorgement under California’s Unfair Competition Law (UCL), and an injunction against Home Depot to prevent further unlawful practices. Furthermore, Lujan requests attorney fees and costs associated with bringing this lawsuit forward.
