Richard Anilao has filed a lawsuit against City View Post Acute and several associated entities and individuals, alleging personal injury, negligence, public nuisance, and unlawful retaliation. The complaint was submitted by Richard Anilao in pro se to the San Francisco County Superior Court on January 8, 2025. Anilao's allegations center around his experiences as a Certified Nursing Assistant (CNA) at various healthcare facilities, culminating in significant health issues purportedly due to inadequate safety measures and retaliatory actions by his employers.
Anilao's journey began with his certification as a CNA in November 2017, leading to employment with Life Generations Healthcare LLC at their Walnut Creek location. Over the years, he worked through multiple staffing agencies at various healthcare facilities across California and Oregon. His roles included adhering to strict infection control protocols during the COVID-19 pandemic while working at the San Francisco Veterans Affairs Medical Center (SFVA) and John Muir Health. Despite stringent measures observed at these institutions, Anilao alleges that City View Post Acute failed to maintain similar standards.
The complaint details how Anilao was exposed to COVID-19 while working at City View Post Acute in January 2023. He asserts that despite assurances of no active COVID-19 cases on his assigned unit, he was exposed to six COVID-positive patients without adequate protective equipment or a properly fitting N95 mask. This exposure led to severe symptoms and a diagnosis of restrictive lung disease. Anilao claims that the defendants' negligence extended beyond inadequate PPE provisions; they also allegedly violated several state laws regarding infection control and employee safety.
Anilao seeks damages for personal injury, medical expenses, pain and suffering, lost wages, and other relief deemed appropriate by the court. He accuses the defendants of breaching their duty of care by failing to provide necessary training on patient transfer equipment and retaliating against him for raising valid safety concerns. Additionally, he highlights violations of California labor laws protecting employees from unsafe working conditions and retaliatory termination.
Representing himself in this legal battle is Richard L. Anilao. The case is being overseen by the San Francisco County Superior Court under Case ID CGC-25-621246.
