Maximilian Watson, a minor represented by his guardian Anna Watson, has filed a lawsuit alleging professional negligence against several healthcare providers. The complaint was filed on January 16, 2025, in the Superior Court of California, County of Santa Clara, targeting Good Samaritan Hospital, Gardner Health Services, and Dr. David Feldman among others.
The case revolves around Maximilian's medical treatment that began in July 2023 when he was diagnosed with Osgood-Schlatter’s disease at Gardner Health Services. Despite undergoing physical therapy and using crutches for severe knee pain, his condition worsened. On November 11, 2023, Maximilian visited the emergency department at Good Samaritan Hospital after a fall exacerbated his knee pain. However, according to the complaint, there was no comprehensive assessment or imaging of his hip conducted at that time. It wasn't until March 5, 2024, that he was correctly diagnosed with slipped capital femoral epiphysis (SCFE), a serious hip condition requiring immediate surgical intervention.
The lawsuit claims that the defendants failed to provide proper care and timely diagnosis which led to prolonged suffering and unnecessary treatments for Maximilian. His guardian alleges that the defendants' negligence resulted in delayed treatment of SCFE which required surgery at Lucille Packard Children’s Hospital-Stanford. The complaint details multiple instances where medical professionals allegedly did not meet the standard care expected from them. "Defendants owed a duty of ordinary care to Maximilian," states the document, emphasizing their failure to diagnose and treat his condition appropriately.
Maximilian seeks damages exceeding $35,000 for past medical expenses and pain suffered due to what is claimed as professional negligence by the defendants. The plaintiff requests general and special damages as well as any other relief deemed appropriate by the court.
Representing Maximilian Watson is attorney Steven F. Calderwood from Calderwood Law Group. The case is presided over by Judge A. Hernandez under Case ID: 25CV456711.
