Lisa Cagliostro has filed a lawsuit against her acupuncturist, alleging severe injuries resulting from medical negligence and malpractice. The complaint was filed by Cagliostro on January 15, 2025, in the Superior Court of California, County of Santa Clara, against Adam Kinnaird Atman, also known as Adam Kinnaird Johnson, and his business entity Adam K. Atman, Acupuncturist, Inc.
The case revolves around two acupuncture sessions that took place on January 2 and January 4, 2024. According to the lawsuit, during these sessions, Cagliostro sustained severe burns and suffered significant emotional distress due to the alleged negligence of Atman and his associates. The plaintiff accuses the defendants of failing to provide adequate care and not obtaining informed consent before performing the procedures. "Defendants performed a medical procedure without Plaintiff's consent," states the complaint.
Cagliostro claims that the treatments were conducted below acceptable medical standards and lacked necessary oversight. She further alleges that Atman's conduct resulted in permanent scarring and potential nerve damage. The complaint also highlights that Atman admitted wrongdoing in relation to Cagliostro's injuries.
In addition to medical negligence and malpractice, Cagliostro accuses Atman of medical battery for conducting a different procedure than what she had consented to. She is seeking compensation for both economic damages such as loss of earnings and non-economic damages including physical pain and emotional suffering.
The plaintiff demands a jury trial and seeks general damages according to proof, coverage for past and future medical expenses, compensation for lost earnings and earning capacity, as well as other special damages deemed appropriate by the court.
