Plaintiff alleges former employer Gilroy IM 2 LLC violated labor laws

Edward Lee has taken legal action against his former employer, Gilroy IM 2 LLC, alleging a series of labor violations under the Private Attorneys General Act (PAGA) in California. The complaint was filed on January 13, 2025, in the Superior Court of California for the County of Santa Clara. The lawsuit accuses Gilroy IM 2 LLC of failing to adhere to multiple provisions of the California Labor Code, affecting not only Lee but also other aggrieved employees.

The lawsuit outlines several grievances against Gilroy IM 2 LLC, claiming that the company failed to pay employees for all hours worked, including minimum wage and overtime. It is alleged that employees were often required to work "off-the-clock" without compensation and were not provided with mandatory meal and rest breaks as required by law. The complaint further asserts that Gilroy IM 2 LLC did not maintain accurate records of hours worked or meal periods taken by its employees. Additionally, Edward Lee claims that the company failed to timely pay final wages upon termination and did not furnish accurate wage statements.

According to the filing, these actions are in violation of several sections of the California Labor Code, including sections related to wage payments, record-keeping requirements, and employee indemnification for necessary expenditures. Lee's legal team argues that these violations were willful and deliberate on the part of Gilroy IM 2 LLC. As a result, they are seeking civil penalties on behalf of Edward Lee and other similarly aggrieved employees under PAGA.

In terms of relief sought from the court, Edward Lee is requesting a declaration that Gilroy IM 2 LLC violated various provisions of the California Labor Code. He seeks an award for civil penalties both individually and on behalf of other affected employees. Furthermore, he is asking for pre-judgment and post-judgment interest at the maximum rate allowed by law, reasonable attorneys' fees and costs incurred during litigation, as well as injunctive and declaratory relief where applicable under PAGA.
