Yvette Augmon, a resident of San Francisco, has filed a medical malpractice lawsuit against the City and County of San Francisco, doing business as Zuckerberg San Francisco General Hospital and Trauma Center, UCSF Medical Center, and the Regents of the University of California. The complaint was lodged in the Superior Court of California for the County of San Francisco on January 28, 2025. Augmon alleges that negligent care during her hospital stay led to significant injuries.
According to the lawsuit, on February 15, 2024, Yvette Augmon was admitted to Zuckerberg San Francisco General Hospital for heart complications. During her stay, she required relocation within the hospital for further testing. Augmon informed an assisting nurse that she needed a wheelchair due to her inability to walk. However, the nurse refused and insisted that Augmon could walk unaided. As a result of being pulled by the arm by this nurse, Augmon fell onto her tailbone. Despite another staff member offering assistance with a wheelchair, the nurse again denied its necessity and attempted to make Augmon walk again, leading to another fall which injured her knees.
Augmon's attorney claims these actions constitute negligence on behalf of the hospital staff and have resulted in ongoing physical injuries as well as emotional distress for their client. The plaintiff reported these incidents to her attending doctor who documented them by writing up the nurse involved.
The legal filing outlines that despite presenting a government claim regarding this incident on June 21, 2024, it was denied by July 31st under Section 945.6 of the California Government Code. This denial prompted Augmon to pursue legal action against those she holds responsible: CITY AND COUNTY OF SAN FRANCISCO dba ZUCKERBERG SAN FRANCISCO GENERAL HOSPITAL AND TRAUMA CENTER; UCSF MEDICAL CENTER; REGENTS OF THE UNIVERSITY OF CALIFORNIA; along with unnamed defendants listed as DOES 1 TO 100.
Augmon is seeking monetary compensation for both economic damages—such as medical expenses—and non-economic damages related to pain and suffering resulting from alleged negligence during her hospitalization at Zuckerberg San Francisco General Hospital. She has requested general damages according to proof presented in court along with special damages covering medical costs incurred due directly from this incident.
