Safeway accused of negligence following customer's slip-and-fall incident

A San Francisco resident has filed a lawsuit against a major grocery chain, alleging negligence and premises liability after a slip-and-fall incident in one of its stores. Arturo Burgos initiated the complaint against Safeway Inc., filing it on February 3, 2025, in the Superior Court of California, County of San Francisco.

According to the court documents, Arturo Burgos claims that on June 20, 2024, he suffered serious injuries when he tripped over a grape left on the floor in the produce section of a Safeway store located at 3350 Mission Street in San Francisco. The lawsuit accuses Safeway Inc., along with unnamed defendants referred to as DOES 1 through 50, of failing to maintain safe premises for customers. Burgos asserts that Safeway's negligence in inspecting and maintaining the store floor created an unsafe condition that led to his accident. The plaintiff alleges that Safeway did not notice or remove the grape within a reasonable time and failed to provide adequate warnings about the hazard.

Burgos contends that Safeway Inc. had a duty of care towards its customers to ensure their safety while shopping. The complaint highlights several alleged failures by Safeway: inadequate maintenance of the store floor, failure to clean up hazards like the grape promptly, lack of warning signs for potential dangers, and insufficient monitoring of customer areas. These actions are claimed to have breached Safeway's duty of care and directly resulted in Burgos's injuries.

The plaintiff is seeking compensation for general damages related to physical and emotional distress caused by the incident. Additionally, Burgos requests economic damages covering medical expenses incurred due to his injuries. He also seeks prejudgment interest and any other relief deemed appropriate by the court.
