Shaun Willem Bass has filed a lawsuit against the City and County of San Francisco, alleging negligence in maintaining safe road conditions that led to his injury. The complaint was filed on February 4, 2025, in the Superior Court of California, County of San Francisco, with the City and County of San Francisco named as defendants.

The plaintiff, Sean Willem Bass, is a resident of San Francisco County and has brought this action against the City and County of San Francisco along with unnamed defendants referred to as DOES 1 to 20. The complaint stems from an incident on January 29, 2024, when Bass was injured after his scooter's tire got stuck in a pothole near 1443 Hyde St., causing him to fall. Bass claims that the defendants were negligent in their duty to maintain and inspect the premises, leading to unsafe conditions that posed a risk to individuals using the road. He asserts that these conditions were known or should have been known by the defendants if they had exercised ordinary care.

According to the complaint, Bass served a written claim for damages on August 9, 2024, which was subsequently denied by the City and County of San Francisco. The denial prompted Bass to file this lawsuit under California Government Code sections §§830, 835, and 835.2. These codes pertain to premises liability where public entities can be held liable for injuries caused by dangerous conditions on their property if certain criteria are met.

Bass alleges that due to the negligence of the City and County of San Francisco in maintaining the roadways, he suffered significant physical and emotional injuries requiring medical treatment. He claims these injuries have resulted in ongoing medical expenses and loss of income due to his inability to work. As part of his legal action, Bass seeks general damages for pain and suffering as well as special damages covering past and future medical expenses. Additionally, he requests compensation for lost income and diminished earning capacity resulting from his injuries.

Representing Sean Willem Bass is attorney Shaun J. Bauman from Bauman Law APLC based in Calabasas, California. The case is presided over by Judge Sahar Enayati under Case ID CGC-25-622052.
