A former employee of a well-known hospital has filed a lawsuit alleging serious workplace violations, including wrongful termination and age discrimination. On April 16, 2025, Nicole Marozick filed a complaint in the Superior Court of California, County of Santa Clara, against Samaritan, LLC doing business as Good Samaritan Hospital, along with Amy McColley and Nancy Charron-Escribano.
Nicole Marozick claims that her termination from Samaritan, LLC was not only unjust but also retaliatory. She began her career at the hospital in 1999 and had never received any formal warnings throughout her tenure. The lawsuit outlines multiple grievances including whistleblower retaliation under Labor Code § 1102.5, wrongful termination in violation of public policy, age discrimination under Government Code § 12940(a), intentional infliction of emotional distress, retaliation for taking sick leave (Labor Code § 233), failure to provide rest breaks and meal periods (California IWC Wage Order No. 5; Labor Code §§ 226.7 and 512), waiting time penalties (Labor Code § 203), and failure to provide accurate time statements.
Marozick's complaint paints a picture of chronic understaffing at the hospital’s labor and delivery department leading to burnout among staff and compromised patient care quality. Despite raising these concerns with supervisors including McColley and Charron-Escribano over several years, no action was taken by the hospital management. Her situation worsened when she took protected sick leave to care for her ill child. Upon returning to work, she discovered that her complaints about patient safety had been shared with supervisors which allegedly led to her termination in violation of the collective bargaining agreement.
The complaint further alleges that after Marozick's dismissal, only nurses over the age of 40 were terminated and replaced by younger counterparts under the age of 40—an act she believes constitutes age discrimination. Additionally, Marozick claims she was denied reimbursement for missed rest breaks and meal periods during her employment.
In terms of relief sought from the court, Marozick is demanding general and special damages according to proof for each cause of action outlined in her complaint. She is also seeking punitive damages intended to punish Samaritan LLC for its alleged wrongful conduct as well as attorney’s fees pursuant to various sections of the Labor Code and Government Code cited within the complaint.
