In a dramatic legal move, a former employee has filed a class-action lawsuit against his previous employer, alleging widespread labor violations. The complaint was lodged by Briant Hernandez on February 13, 2025, in the Superior Court of California, County of Santa Clara, targeting Kumar Management Corporation and its subsidiary.
Briant Hernandez claims that Kumar Management Corporation and Kumar Management Corp. II, Inc., both with principal offices in Foster City, California, systematically violated various provisions of the California Labor Code over the past four years. Hernandez accuses the companies of failing to pay minimum wages and overtime compensation as required under Labor Code § 510. He alleges that employees were often required to work off-the-clock during onboarding processes and perform tasks before and after their shifts without proper compensation. "Defendants had a consistent policy of not paying Employees wages for all hours worked," states the complaint.
The lawsuit further alleges that Kumar Management failed to provide lawful meal and rest periods as mandated by Labor Code § 226.7. Employees reportedly worked through their breaks due to workplace demands or were interrupted during these periods. Additionally, the complaint accuses the company of not reimbursing employees for necessary business expenses such as personal cellphone usage and other work-related costs.
Hernandez is seeking several forms of relief from the court. These include compensatory damages for unpaid wages and overtime from at least four years prior to filing the action, liquidated damages equal to unpaid minimum wages plus interest, penalties for inaccurate wage statements under Labor Code § 226(e), and restitution for unfair competition pursuant to Business & Professions Code § 17200 et seq. The plaintiff also seeks an injunction against Kumar Management to prevent further violations.
