Plaintiff Engineering Firm Accuses Former Employee of Breach of Duty and Contract

Analatom, Inc., a California-based engineering company, has taken legal action against a former employee, alleging serious breaches of loyalty and contract. On February 13, 2025, Analatom filed a complaint in the Superior Court of California, County of Santa Clara, accusing Duane Darr of multiple offenses including breach of duty of loyalty and contract, among others.

The case stems from allegations that Duane Darr, who was employed by Analatom starting February 26, 2008, engaged in unauthorized activities detrimental to the company. According to the complaint filed by Analatom's attorneys at McLellan Law Group LLP, Darr violated a non-disclosure agreement intended to protect proprietary information. The plaintiff claims that during his tenure and after his employment ended, Darr redirected client communications away from Analatom’s CEO Bernard Laskowski to himself without authorization. This allegedly resulted in significant business losses for Analatom.

Further accusations include Darr's refusal to perform tasks necessary for ongoing contracts and failing to return company property upon termination. The complaint also states that Darr used Laskowski’s electronic signature for unauthorized purchases and solicited business from Analatom’s clients while still employed with them. These actions are said to have disrupted existing contracts and potential economic relationships between Analatom and its clients.

Analatom is seeking various forms of relief through this lawsuit. They demand actual damages amounting to no less than $1.5 million due to lost business opportunities and reputational harm caused by Darr's alleged misconduct. Additionally, they seek punitive damages aimed at punishing Darr for his actions as well as restitution for unjust enrichment derived from using company resources for personal gain.

The case has been assigned Case No. 25CV458808 with Judge J. Nguyen overseeing proceedings.
