CSAA Insurance Exchange has filed a lawsuit against Cosmos Roofing, Inc., accusing the company of negligence that resulted in significant damage to a client's home. The complaint was filed on February 26, 2025, in the State Court of California, County of Santa Clara. CSAA alleges that Cosmos Roofing failed to adequately protect a partially reroofed home from an impending rainstorm, leading to substantial water damage.
The case revolves around an incident that occurred on December 31, 2022. According to the complaint, Cosmos Roofing was responsible for reroofing the home of Shiuh-Ming Luoh, who is insured by CSAA. The plaintiff claims that Cosmos and its unnamed associates (Does 1-10) did not exercise due care during their work, which led to water intrusion and extensive damage to the property. CSAA had to cover repair costs amounting to $88,101.88 under Luoh's homeowner’s insurance policy.
CSAA Insurance Exchange argues that it has been subrogated to all rights of its insured against Cosmos Roofing due to the payments made for repairs and losses incurred by Luoh. The insurance exchange is seeking damages equivalent to the amount paid out for repairs and additional compensation for fees and costs associated with the lawsuit. They are also requesting interest as allowed by law and any other relief deemed appropriate by the court.
