Sarah Gerome has taken legal action against a real estate company, accusing them of professional negligence that has allegedly caused her and her family significant distress. On April 22, 2025, Sarah Gerome filed a complaint in the Superior Court of California, County of San Francisco, against Side, Inc., alleging that their realtor failed to disclose critical defects in a property she purchased.

The case revolves around the purchase of a home located at 7580 Latrobe Road, Shingle Springs, California. According to Gerome's complaint, Brett Hamilton, the listing agent for Side, Inc., neglected to inform her about several known issues with the property’s water supply system. The property relied on an outdated hand-dug well with sanitation problems and potential water production issues due to its age and style. Despite these known issues, Hamilton allegedly assured Gerome’s buyer’s agent via email that "the well is all good to go," without mentioning any sanitary concerns or lack of inspection.

Gerome claims that these omissions were intentional and aimed at securing the sale after another potential buyer withdrew their offer upon learning about the well's condition. The situation came to light when Gerome's water supply stopped on November 4, 2023. A well technician confirmed on November 6 that both the sellers and Hamilton were aware of these issues since November 23, 2021.

The aftermath has been devastating for Gerome and her family. They faced severe anxiety and depression from unknowingly consuming contaminated water for over a year. Despite moving out in July 2024 due to emotional distress associated with living in the house, Gerome continues to suffer from mental health challenges exacerbated by this ordeal.

In addition to seeking $2.5 million for emotional distress damages calculated using an emotional distress multiplier due to its pervasive impact on her life, Gerome requests that Side, Inc. repurchase the property at either its original price plus investments or fair market value as determined by an independent appraiser—whichever is higher.

Gerome's complaint also highlights multiple unsuccessful attempts at mediation through C.A.R.'s Real Estate Mediation Center for Consumers and arbitration via JAMS before resorting to litigation. She urges Side, Inc. to improve their communication protocols and accountability measures within their organization.

Representing herself in this case (IN PRO PER), Sarah Gerome seeks justice against Side Inc., hoping for resolution after enduring prolonged hardship caused by alleged negligence during her home purchase process.
