In a gripping legal battle, the family of a deceased man has taken a bold step by filing a lawsuit against several medical professionals and institutions, alleging medical malpractice that led to his untimely death. The complaint was filed by Donna Kyono and the Estate of Brian Kyono in the Superior Court of California, County of San Francisco, on February 28, 2025. The defendants named in this case include Crawford Chung, M.D., Hill Physicians Medical Group, Inc., SimonMed Imaging, Ricardo Centeno, M.D., Brian Brune, M.D., and other unnamed parties.
The plaintiffs assert that the defendants' negligence in diagnosing and treating Brian Kyono's cancer resulted in his wrongful death on September 12, 2024. According to the complaint, from December 2022 onwards, Brian Kyono sought medical care from these defendants for his cancer treatment. However, the plaintiffs allege that the care provided was careless and negligent. "Defendants failed to monitor and supervise his care," states the complaint, leading to devastating consequences.
The lawsuit accuses the defendants of failing to provide adequate hospital care, surgical procedures, post-surgical care, and pharmaceutical services. As a result of these alleged failures, Donna Kyono claims she has been deprived of her husband's companionship and financial support. The plaintiffs are seeking damages exceeding the court's jurisdictional minimum for both general and special damages related to loss of earnings and burial expenses.
Furthermore, under California law provisions cited in their complaint—specifically Code of Civil Procedure §§377.30 and 377.34—the plaintiffs seek survival action damages for losses incurred by Brian Kyono before his death. This includes any penalties or punitive damages he would have been entitled to recover had he survived.
