On March 14, 2025, Jon Bumann and Tachymeters LLC filed a complaint in the Superior Court of California, County of San Francisco, against Highgate Hotels, L.P., Tiffany Zimmer-Penton, and other unnamed defendants. The plaintiffs are seeking damages exceeding $35,000 due to alleged negligence and negligent hiring practices that resulted in theft and emotional distress.
The case centers around an incident on May 4, 2024, when Jon Bumann was staying at Hotel Caza in San Francisco. According to the complaint, Bumann was in the hotel lobby when several suspects were negligently allowed to enter and remain on the premises by the hotel's management and security staff. This lapse allegedly enabled the suspects to execute a scheme that deprived Bumann and his company of their property. The plaintiffs argue that Highgate Hotels and its employees failed to maintain a safe environment for guests, thereby breaching their duty of care. "Defendants owed a duty to Plaintiffs because...the HOTEL was in a special relationship with Plaintiffs as an innkeeper," states the complaint.
The lawsuit further accuses Highgate Hotels of negligent hiring and supervision practices. It claims that the defendants carelessly selected and retained employees who were unfit for their roles, which directly contributed to the harm suffered by Bumann. The plaintiffs assert that these negligent actions were substantial factors in causing their damages, including physical injuries, emotional distress, loss of earnings, and damage to personal property.
In addition to general damages for pain and suffering, the plaintiffs seek special damages related to medical expenses incurred due to injuries sustained during the incident. They also request prejudgment interest on any awarded amounts. Through this legal action, Bumann aims not only for compensation but also for accountability from those he believes failed in their responsibilities.
