Eileen Garcia, a former employee of CIASOM LLC, has filed a lawsuit against the company alleging multiple violations of California labor laws. The complaint was filed on April 1, 2025, in the Superior Court of California, County of Santa Clara. Garcia accuses CIASOM LLC of whistleblower retaliation and several other labor code violations.
According to the complaint, Eileen Garcia worked as a Production Supervisor for CIASOM LLC from February 9, 2021, to October 20, 2021. During her employment, she faced religious discrimination when her request for religious accommodations was initially honored but later ignored. On July 12, 2021, Garcia was directed to work seven days a week despite her prior agreement with management that allowed her time off for religious observance on Thursdays and Sundays. When she reiterated her request for accommodation via email to Heather Fedor in Human Resources on the day of her termination, she was abruptly dismissed without explanation by General Manager Tod Royer.
Garcia's lawsuit details numerous grievances including being denied meal and rest breaks due to workload demands and lack of coverage. She claims that these conditions led to health issues such as a bladder infection due to not being able to take restroom breaks. Despite raising these concerns with supervisors James Weland and Tod Royer as well as HR representative Heather Fedor, her complaints were allegedly ignored. Furthermore, Garcia asserts that she was forced to work without a day of rest in violation of California's "Day of Rest" law during more than one-third of her employment period.
The plaintiff is seeking compensation for unpaid wages including meal and rest break premiums which were not provided by CIASOM LLC. Additionally, Garcia is demanding statutory penalties under various sections of the California Labor Code for failure to furnish compliant wage statements and produce employment records upon request. She also seeks damages for unfair competition practices under California Business & Professions Code §17200 et seq., arguing that CIASOM LLC gained an unfair advantage over competitors through their unlawful practices.
