In a dramatic turn of events, a former office manager has taken legal action against her previous employer, alleging wrongful termination and violation of employment rights. On April 2, 2025, Jeannette Mariscal filed a complaint in the Superior Court of California, County of Santa Clara, against LGTC Group, Inc., claiming that her dismissal was unlawful and retaliatory.
Jeannette Mariscal's lawsuit against LGTC Group, Inc., a mental health services provider based in San Jose, California, accuses the company of multiple violations including the California Family Rights Act (CFRA) and California Labor Code. Mariscal worked as an Office Manager for LGTC Group from September 2021 until February 2025. Despite receiving exemplary performance reviews and a merit raise in December 2024, she faced abrupt changes in January 2025 when she was placed on a Performance Improvement Plan by Clinical Director Nupur Jain. The plan accused her of inappropriate conduct regarding workplace discussions about wages and working conditions—actions protected under California law.
Mariscal contends that her termination was not only unjust but also violated several provisions of California law designed to protect employees' rights to discuss wages and working conditions. She cites specific sections such as Labor Code Section 232 and Section 1197.5(k), which safeguard employees from retaliation for discussing their pay or workplace conditions. Furthermore, Mariscal alleges that LGTC Group interfered with her rights under the CFRA by terminating her employment following a medical leave approved by the company itself.
The plaintiff seeks various forms of relief from the court: reinstatement to her position or compensation for lost wages and benefits; damages for emotional distress; punitive damages due to malicious conduct by LGTC Group; and coverage of attorney fees incurred during litigation. The complaint underscores that LGTC Group's actions were not only retaliatory but also indicative of broader systemic issues within the company's management practices.
Representing Jeannette Mariscal is attorney Daniel J. Muller from Ventura Hersey & Muller LLP. The case is presided over by Judge Y. Chavez under Case ID 25CV462729.
