In a recent legal filing, a prominent corporation has taken decisive action against another business entity over an alleged breach of contract. The complaint was filed by Herc Rentals, Inc., in the Superior Court of California, City and County of San Francisco on April 1, 2025, naming 2040 Services as the defendant. This case underscores the importance of contractual obligations and the potential repercussions when such agreements are not honored.

According to the complaint, Herc Rentals entered into a written agreement with 2040 Services on June 30, 2022. The agreement involved the rental of equipment, which Herc Rentals claims to have provided in accordance with all stipulated terms. However, it is alleged that 2040 Services failed to fulfill their end of the bargain by neglecting to pay for these rentals. As a result, Herc Rentals asserts that they have suffered damages amounting to $15,528.38. The plaintiff's complaint details that despite multiple demands for payment made between June 20 and August 26, 2024, no payments were received from the defendants.

The plaintiff accuses 2040 Services and its guarantor Tariq E. Ayyad (also known as Terry Ayyad) of breaching their contractual obligations by failing to settle outstanding invoices related to equipment rentals. Furthermore, Herc Rentals argues that this breach is not covered under certain sections of the Civil Code because it did not arise from a retail installment contract or involve motor vehicle financing. The complaint also highlights that interest at a rate of 10% per annum is due on the unpaid sum from August 26, 2024.

Herc Rentals is seeking judgment against the defendants for several forms of relief: compensatory damages totaling $15,528.38; interest accruing at a rate of 10% per annum from August 26, 2024; reasonable attorneys' fees amounting to $2,000 if uncontested or more if contested; and costs associated with bringing this suit forward. Additionally, they request any further relief deemed appropriate by the court.

The legal team representing Herc Rentals includes Robert L. Pollak and Dominique S. Angelo from Glassberg, Pollak & Associates based in San Rafael, California. The case has been assigned Case No: CGC-25-623863 in front of judges at the Superior Court of California in San Francisco.
