Union Security Insurance Co. accused of breach of contract

FRESNO – A Lindsay woman is suing an insurance company over claims it denied her long-term disability benefits.

Magdalena Sanchez filed a complaint on Feb. 9 in the U.S. District Court Eastern District of California, Fresno Division against Union Security Insurance Co., citing breach of contract, insurance bad faith and intentional infliction of emotional distress.

According to the complaint, the plaintiff alleges that on Jan. 30, 2014, she stopped working due to several medical conditions. These were verified when plaintiff submitted medical records to the defendant when she applied for long-term disability benefits, the complaint states. The defendant allegedly denied plaintiff's long-term disability benefit claims multiple times despite meeting all the conditions of the plan with medical records to support her claims.

The plaintiff seeks the compensatory damages of $132,956.60, plus 10 percent interest on past due benefits, for past and future disability benefits, $5 million in compensatory damages for emotional distress, and attorney's fees, costs of the suit and any other relief this court deems just and proper.
