SAN FRANCISCO – A commercial fisherman is suing his employer after he alleges he was injured on the job.

Florencio Hernandez Castaneda filed suit Feb. 12 in the U.S. District Court for the Northern District of California against Steve Bradley and the fishing vessel Sound Adventure, citing negligence.

According to the complaint, the plaintiff alleges that on March 5, 2013, he was injured aboard the Sound Adventure, asked the defendant for time off, and one day was granted. Castaneda alleges that he returned to work and worked until his lower extremities became numb, and that Bradley should have sent him to receive appropriate health care and placed him under a not fit for duty condition. The plaintiff alleges that he has suffered physical and emotional injuries, loss of wages and earning power.

The plaintiff seeks the following: damages of $1 million, maintenance and cure, prejudgment interests, attorney's fees, costs of the suit and any other relief the court deems just and proper. He is represented by Arnold I. Berschler and Nicholas R. Lane of Berschler Associates PC in San Francisco.
