McKesson Corp. sues Florida corporation over alleged breach of contract

SAN FRANCISCO – A San Francisco company is suing a Florida corporation over allegations of an unpaid invoice.

McKesson Corp. filed a complaint Feb. 16 in the U.S. District Court Northern District of California against Omni Healthcare Inc., citing breach of contract.

According to the complaint, between Nov. 1, 2014, and Jan. 22, McKesson Corp. and the defendant entered into a written agreement for medical supplies. All the goods were shipped to the defendant by the plaintiff with each invoice due to be paid 30 days from the date of each invoice, the suit states. The plaintiff holds Omni Healthcare Inc. responsible because it allegedly failed and refused to pay the plaintiff the amount due, including a finance charge of 1.5 percent per month on all past due invoices.

The plaintiff seeks the following: compensation for all damages; the invoice amount of $325,702.38, including interest; reasonable attorney's fees, costs of the suit and any other relief the court deems just and proper. It is represented by Scott O. Smith and Mancy Pendergrass of Buchalter Nemer in Los Angeles.
