Hartford Life and Accident Insurance Co. accused of breach of contract

SAN FRANCISCO – A woman is suing a Connecticut-based insurance company claiming breach of contract in its denial of long-term disability benefits.

Arlene Tom filed a complaint on March 2 in the U.S. District Court Northern District of California against Hartford Life and Accident Insurance Co., citing breach of contract.

According to the complaint, the plaintiff alleges that in 2009 and 2010, she suffered injuries which required her to undergo two surgeries. The suit states the plaintiff applied for long-term disability benefits and was initially approved, but later terminated despite multiple appeals. The plaintiff holds Hartford Life and Accident Insurance Co. responsible because the defendant allegedly granted plaintiff's benefit claims but limited them to 24 months based on its policy, stating that plaintiff's condition came under the limited disability provision of the policy.

The plaintiff seeks the following: compensation for all damages plus interest, legal fees incurred during the duration of this suit, and any other relief this court deems just and proper. She is represented by Constantin V. Roboostoff of Roboostoff & Kalkin in San Francisco.
