SAN FRANCISCO – A school is suing an artificial turf maker over allegations that the turf installed failed prematurely and needs replaced.
Crystal Springs Uplands School filed a complaint on March 18 in the U.S. District Court for the Northern District of California against Fieldturf USA Inc., Fieldturf Inc., and Fieldturf Tarkett SAS, citing alleged breach of warranty, fraud, unfair competition and negligent misrepresentation.
According to the complaint, the plaintiff alleges that it suffered damages as a result of substandard quality products bought and installed on its athletic field. The plaintiff holds Fieldturf USA Inc., Fieldturf Inc. and Fieldturf Tarkett SAS responsible because the defendants allegedly provided less durable products that failed prematurely and knowingly ignored plaintiff's claim for warranty.
The plaintiff seeks the following: compensation for all damages in the amount of $293,760, all legal fees and any other relief as the court deems just and proper. They are represented by Peter F. Lindborg and Irina J. Mazor of Lindborg & Mazor LLP in Glendale.
