Trust funds allege Studer's Floor Covering owes more than $2 million

SAN FRANCISCO – Two Alameda-based trust funds allege they are owed by a business for unpaid withdrawal liability.

Resilient Floor Covering Pension Trust Fund board of trustees and Resilient Floor Covering Pension Trust Fund filed a complaint on May 6 in the U.S. District Court for the Northern District of California against Studer's Floor Covering Inc. citing violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that on Dec. 31, 2009, the defendant withdrew from the pension fund and that they are owed $2,291,014 for withdrawal liability. The plaintiffs hold Studer's Floor Covering Inc. responsible because the defendant allegedly failed and refused to pay the plaintiffs despite being notified.

The plaintiffs seek judgment against the defendant, payment of unpaid payments due to the plaintiffs plus interest and liquidated damages, all legal fees and any other relief as this court deems just. They are represented by George M. Kraw, Donna L. Kirchner and Katherine McDonough of Kraw Law Group in Mountain View.
