SAN FRANCISCO – A board of trustees alleges that a Richmond business owes unpaid contributions.
The board of trustees in its capacities as trustees for the National Roofing Industry Pension Plan filed a complaint on May 13 in the U.S. District Court for the Northern District of California against Westech Roofing, citing breach of contract and violation of the Employee Retirement Income Security Act.
According to the complaint, the defendant was delinquent in paying contributions to the plaintiff in the sum of $32,912.62 and entered into a payment arrangement. The plaintiff alleges that it is still owed $5,170.04.
The plaintiff seeks order for the defendant to pay $5,170.94 for unpaid contributions, liquidated damages on unpaid contributions estimated to be at least $6,191.37 plus attorney's fees related to its agreement in the amount of $2,500, interest, all legal fees and any other relief as this court deems just.
