SACRAMENTO – A New York company seeks the court's declaration to settle trademark infringement allegations by California businesses.
Belstone Capital LLC filed a complaint on May 24 in the U.S. District Court for the Eastern District of California against Bellstone Partners LLC, Bellstone Commercial Inc., and BellstoneShares LLC, seeking a declaratory judgment of noninfringment of trademark and for cancellation of a trademark registration.
According to the complaint, the plaintiff is a corporate finance company specializing in technology and capital formation while the defendants are financial providers for real estate development projects. The plaintiff alleges that the defendants claim the plaintiff is infringing their trademarks and have sent it cease and desist letters. The defendants allege the plaintiff's mark would lead to the confusion of its customers.
The plaintiff requests a trial by jury and seeks declare that plaintiff has not infringed any trademark rights of the defendant, order to cancel the defendants' '103 trademark registration, all legal fees and any other relief as the court deems just.
