SAN DIEGO – A film production company with offices in Los Angeles alleges that a BitTorrent user unlawfully distributed its film on the peer-to-peer site.
Cell Film Holdings LLC filed a complaint on Oct. 17 in the U.S. District Court for the Southern District of California against Doe-174.68.74.64 alleging copyright infringement.
According to the complaint, the plaintiff alleges that it was caused to suffer profit injury by unauthorized distribution of its copyrighted property, the motion picture "Cell," by the defendant currently known only by its internet protocol address, by peer-to peer exchange through a BitTorrent network. The suit states that the plaintiff intends to seek initial discovery to subpoena records from Cox Communications, defendant's internet service provider, to ascertain the true identity and information regarding the defendant.
The plaintiff requests a trial by jury and seeks judgment against the defendant, permanent injunction, damages, costs of suit, attorney's fees and further relief as the court deems proper. It is represented by James S. Davis in Chula Vista.
