Plaza Motors of Brooklyn Inc. accused of misrepresenting car as new, undamaged

SACRAMENTO – An active duty member of the U.S. Air Force stationed at Travis Air Force Base alleges a Brooklyn auto dealer misrepresented the history of a vehicle he purchased.

Brandon Buelow filed a complaint on Oct. 31 in the U.S. District Court for the Eastern District of California against Plaza Motors of Brooklyn Inc., doing business as Plaza Honda, citing the California Song-Beverly Consumer Warranty Act, the Federal Magnuson-Moss Warranty Act and the New Jersey Consumer Fraud Act.

According to the complaint, the plaintiff alleges that on Nov. 21, 2015, he purchased what he assumed and what the defendant marketed as a brand-new, undamaged Honda Pilot motor vehicle. The plaintiff alleges that he learned through a CarFax Vehicle History Report that the subject vehicle was indeed sold to a previous owner, who refused to accept the vehicle back because of an accident that damaged the vehicle while it was in the possession of the defendant for a minor repair. He alleges the defendant did not disclose information about the damage to him and as a result, he overpaid for the vehicle.

The plaintiff holds Plaza Motors of Brooklyn Inc. responsible because the defendant allegedly failed to disclose the subject vehicle’s used status and its accident prior to time of sale.

The plaintiff requests a trial by jury and seeks judgment against defendant, rescission of the sale contract and restitution of payment, damages, interest, equitable relief, civil penalty, attorneys’ fees, costs of suit and further relief as the court deems proper.
