SAN DIEGO – A La Jolla company claims a Los Angeles individual and his company copied its hair accessories and used its copyrighted photo on the packaging.
Luminence LLC filed a complaint on Nov. 10 in the U.S. District Court for the Southern District of California against Ricardo Castorena LLC and Ricardo Castorena alleging copyright infringement.
According to the complaint, the plaintiff alleges that it manufactures Glowbys brand hair attachments and has copyrighted a photo of a model wearing the accessories. It alleges the defendants were selling online goods of the same kind as plaintiff's on eBay and that the packaging used for defendants' hair clip products displayed an infringing copy of plaintiff's copyrighted work.
The plaintiff holds Ricardo Castorena LLC and Castorena responsible because the defendant allegedly utilized plaintiff's copyrighted photograph without consent.
The plaintiff requests a trial by jury and seeks judgment against defendants, damages, profits, attorneys’ fees, costs and further relief as the court may deem just. It is represented by Matthew H. Capron of Capron Law Offices in Chula Vista.
