LOS ANGELES – A Placentia garment company alleges a San Francisco business has used its patented technology for an undershirt.
3 Pak Holdings LLC filed a complaint on Nov. 11 in the U.S. District Court for the Central District of California against Aussie Armor LLC, doing business as Ejis Inc., and Does 1-10 citing patent infringement.
According to the complaint, the plaintiff alleges that it owns all the rights, title and interest to the '812 patent titled Garment Having Integrated Perspiration Barriers. It alleges the defendant's Micro Modal Sweat Proof Undershirts copy this patented technology without permission.
The plaintiff requests a trial by jury and seeks judgment against the defendants, preliminary and permanent injunction, attorneys’ fees and costs incurred and further relief that the court may deem just.
