WildFox Couture, WildFox Retail allege T-shirt did not infringe copyrighted design

LOS ANGELES – Two Cypress companies that design and distribute apparel are seeking the court's help in a copyright issue.

WildFox Couture LLC and WildFox Retail LLC filed a complaint on Nov. 11, in the U.S. District Court for the Central District of California against Cat Coven LLC seeking declaratory judgment.

According to the complaint, the defendant has accused the plaintiffs of infringing a T-shirt design. The plaintiffs allege that the defendant does not have registered copyright in the design that it is accusing plaintiffs to have infringed upon and that the defendant cannot prosecute trademark infringement claims against them because it is not the legal owner of any exclusive rights under trademark or trade dress.

The plaintiffs seek declaratory judgment against the defendant, and other relief as the court deems just and proper. They are represented by Matthew L. Seror and Philip L. Nulud of Buchalter Nemer in Los Angeles.
