LOS ANGELES – The copyright owner of a textile design alleges two companies have unlawfully used its design without permission.
Unicolors Inc. filed a complaint on Nov. 17 in the U.S. District Court for the Central District of California against Just One LLC, doing business as Just One, and 10 Spot of Kearny LLC, doing business as Madrag Clothing and Does 1-10 alleging copyright infringement.
According to the complaint, the plaintiff alleges that it is the owner and author of a two-dimensional artwork called CEO611 and was granted copyright registration from the United States Copyright Office. It alleges that the defendants purchased, sold, marketed, advertised, manufactured, imported and/or distributed fabric and/or garments comprised of fabric featuring a design that is similar to the subject design, causing plaintiff to suffer damages to its reputation and goodwill.
The plaintiff requests a trial by jury and seeks judgment against defendants, enjoin defendants against further infringement, awarded all profits of defendants, statutory damages, attorneys’ fees, interest, costs of litigation and further relief as the court deems proper.
