Matson Navigation Co. alleges Sherwin-Williams Co. paint failed on ship

SAN FRANCISCO – An Oakland-based ocean transportation services company alleges it suffered damages because of a paint job that failed.

Matson Navigation Co. Inc. filed a complaint on Jan. 6 in the U.S. District Court for the Northern District of California against The Sherwin-Williams Co. alleging breach of contract and other counts.

According to the complaint, the plaintiff alleges that in 2014, it issued purchased orders to have the hull of its container ship painted by the defendant. The suit states the vessel was dry docked in China for the painting on April 3, 2015, where the whole process was manned and supervised by the defendant's representatives. The plaintiffs allege that days after the vessel returned to service, plaintiff's personnel discovered that defendant's hull coatings failed, causing all recently applied coating to strip off. As a result of the alleged failure of defendant's paint system, plaintiff was forced to take the vessel out of service for repair. It alleges it suffered damages of more than $5 million.

The plaintiff requests a trial by jury and seeks judgment in favor of plaintiff, interest, costs of suit, and further relief. It is represented by John D. Giffin and Francesca M. Lanpher of Keesal, Young & Logan APC in San Francisco.
