SAN DIEGO — A Spring Valley man is suing Virtuoso Sourcing Group LLC for alleged misrepresentation of debt collection.
Jose Arellano filed a complaint on April 5 in the U.S. District Court for the Southern District of California alleging that the defendant violated the the Fair Debt Collections Practices Act and Rosenthal Fair Debt Collections Practices Act.
According to the complaint, the plaintiff alleges that, on Aug. 4, 2016, he examined his credit report and found that the defendant had re-reported an alleged personal telephone debt from Sprint on his credit report in July 2016 even after plaintiff claims he disputed the alleged debt directly with the defendant with a letter on May 27, 2016.
The plaintiff alleges the defendant failed to examine records first before re-reporting plaintiff's alleged debt in his credit report and failed to disclose in the credit report the dispute letter sent directly by consumer.
The plaintiff requests a trial by jury and seeks judgment for actual and statutory damages, attorney fees, costs and for any such other and further relief as the court deems just and proper. He is represented by Jonathan A. Stieglitz of The Law Offices of Jonathan A. Stieglitz in Los Angeles.
