DB Shoe Co. alleged to have infringed Deckers Outdoor Corp. outsole design

LOS ANGELES – The makers of UGG boots alleges its patented outsole design was unlawfully copied by a Los Angeles company.

Deckers Outdoor Corp. filed a complaint on April 17 in the U.S. District Court for the Central District of California against DB Shoe Co. LLC and Does 1-10, inclusive alleging patent infringement.

According to the complaint, the plaintiff alleges that upon information and belief its Essential Outsole design for UGG boots, to which it owns all the rights and design patent, was unlawfully infringed by the defendants.

The plaintiff holds DB Shoe Co. and Does 1-10, inclusive responsible because the defendants allegedly were not granted a license or any other form of permission to use plaintiff's design with respect to its trademarks, design patent or other intellectual property and misled and confused the public.

The plaintiff seeks to permanently enjoin further infringement of the patent, award for all damages, costs, attorney's fees and such further relief as may be just and proper. They are represented by Brent H. Blakely, Cindy Chan and Jessica C. Covington of Blakely Law Group in Manhattan Beach.
