SAN FRANCISCO – A Livermore individual is alleged to have failed to pay a liability to a union fund.
Pension Plan for Pension Trust Fund for Operating Engineers, Richard Piombo and Russell E. Burns filed a complaint on April 24 in the U.S. District Court for the Northern District of California against Mark Parr, doing business as Tri-Valley Sweeping, and Does 1-10 citing the Employee Retirement Income Security Act.
According to the complaint, the plaintiffs allege that the defendants withdrew from their plans in 2013. The plaintiffs hold Parr and Does 1-10 responsible because the defendants allegedly failed to pay the withdrawal liability.
The plaintiffs seek unpaid withdrawal liability of $108,780, interest at 10 percent, liquidated damages, interest, all legal fees, and any other relief as the court deems just. They are represented by Anne M. Bevington, Michele R. Stafford and Edward D. Winchester of Saltzman & Johnson Law Corp. in San Francisco.
