Structure Properties Inc. accuses individuals of fraud

SAN FRANCISCO – A real estate property management company alleges that it was damaged by the actions of two individuals.

Structure Properties Inc. filed a complaint on April 4 in the San Francisco County Superior Court against David Herscowitz, Moris Herscowitz and Does 1 to 10 alleging breach of contract, fraud and other counts.

According to the complaint, Mori Herscowitz met with the plaintiff in 2015 to discuss transition of property management of his portfolio to the plaintiff. The suit states Moris Herscowitz wanted his son, David Herscowitz, to be hired by the plaintiff as part of to exchange. The plaintiff hired David Herscowitz as a property manager in January 2016, but alleges he was unable to perform his duties. The plaintiff alleges that David Herscowitz was working secretly with competing businesses while still employed by the plaintiff and later worked for a competitor. The suit also states Moris Herscowitz later transferred his portfolio away from the plaintiff to a competitor.

The plaintiff holds David Herscowitz, Moris Herscowitz and Does 1 to 10 responsible because the defendants' alleged misrepresentations caused it to suffer significant monetary damages.

The plaintiff requests a trial by jury and seeks monetary damages, punitive damages, compensatory damages, injunctive relief, all legal fees and interest and any other relief as this court deems just.
