FRESNO – A Fresno restaurant is accused of failing to remove architectural barriers that restrict access to the disabled.
Ronald Moore filed a complaint on April 21 in the Fresno County Superior Court against Alireza Saniefar, trustee of the Bost Trust; Fatemah Saniefar, doing business as Zlfred's; estate of Gholamreza Saniefar; Ali Abubaker doing business as Yem Kabon; and Deos 1 through 10, inclusive alleging that they violated the American with Disabilities Act (ADA) and Unruh Civil Rights Act.
According to the complaint, the plaintiff alleges that on April 14, 2014, and April 30, 2015, plaintiff visited the defendants' establishment and encountered barriers that both interfered with and denied his ability to fully and equally use and enjoy the goods services, privileges offered at the facility.
The plaintiff holds the defendants responsible because the defendants' property did not have accessible restrooms and parking.
The plaintiff requests a trial by jury and seeks judgment for statutory minimum damages in the amount of $8,000, plus attorneys' fees, litigation expenses, cost of suit and such other further relief to which the court deems proper.
