City of Rialto alleged to owe employees unpaid overtime wages

LOS ANGELES – Employees of the city of Rialto allege that they are owed unpaid overtime and other compensation.

Matthew Blanco and Richard Royce, on behalf of themselves and all similarly situated individuals, filed a complaint on May 18 in the U.S. District Court for the Central District of California against city of Rialto alleging that the defendant violated the Fair Labor Standards Act.

According to the complaint, the plaintiffs allege that they were not properly compensated for all hours worked by the defendant due to its improper method of calculating the regular rate of pay, which resulted to underpayment for overtime hours worked. 

The plaintiffs hold the city of Rialto responsible because the defendant allegedly failed to include all requisite forms of compensation in the regular rate of pay used to calculate overtime compensation and compensatory time out cash outs and failed to compensate plaintiffs and similarly situated individuals at a rate of one-and-one-half times the regular rate of pay for all overtime hours as required by the FLSA.

The plaintiffs seek to recover unpaid overtime compensation, attorney fees, costs incurred, injunctive relief ordering to cease and desist unlawful conduct, and for such other relief as the court deems just and proper. They are represented by David E. Mastagni, Isaac C. Stevens and Ace T. Tate of Mastagni Holstedt APC in Sacramento.
