LOS ANGELES — A policy holder is suing Prudential Insurance, alleging violation of the Employee Retirement Income Security Act (ERISA).

Richard Haynes filed a complaint Nov. 15 in U.S. District Court for the Central District of California against The Prudential Insurance Company of America, alleging the defendant breached its duty of good faith and fair dealing.

According to the complaint, on Jan. 9, Haynes suffered substantial monetary losses from Prudential's denial of his plaintiff's long-term disability benefits, that was wrongful and contrary to the terms of the plan despite affirmation from his health care providers. 

The plaintiffs alleges Prudential Insurance deprived him of his disability benefits, and failed to provide a full and fair review of the plaintiff’s claim.

Haynes seeks trial by jury, award of benefits, interest, attorney fees,and all relief the court deems just. He is represented by attorneys Frank N. Darras, Susan B. Grabarsky and Phillip S. Bather of Darras Law in Ontario, California.
