Clovis couple alleges dealer sold defective vehicle

FRESNO — A Clovis couple is suing a Kern County auto dealership, alleging negligence.

Kevin Murphy and Julia Murphy filed a complaint Nov. 16 in Fresno County Superior Court against FCA US LLC and Does 1-10, alleging the defendants obtained profit through distribution of a substandard product.

According to the complaint, on June 26, 2015, the Murphys purchased a 2015 Dodge Ram vehicle from the defendants. The suit says the Murphys have suffered monetary damages from purchasing a defective vehicle that was manufactured and distributed by defendants. 

The Murphys says the defects included leaking oil and low engine oil. However, the lawsuit states, the representative of FCA US has failed to repair the vehicle, breaching the terms of the written warranty on each occasion. 

The plaintiffs allege the defendants have failed to commence service or repairs within a reasonable time and failed to service or repair the vehicle so as to conform to applicable warranties.

The Murphys seek trial by jury, actual damages, civil penalty, consequential and incidental damages, costs of suit, attorney fees, pre-judgment interest, punitive damages, and all other relief the court deems proper. They are represented by attorney Brian K. Cline of Pecora & Cline in La Jolla.
