FRESNO — A Fresno County customer is suing a tiny homes business, alleging breach of contract.
Kevin Yambupah filed a complaint Nov. 21 in Fresno County Superior Court against Jason Englebright, Ashley Cobbs, doing business as KJE Tiny Homes, and Does 1-20, alleging they breached good faith and fair dealing by failing to deliver the product.
According to the complaint, Yambupah suffered monetary damages from the defendants' representation of their ability to build and deliver a tiny home to the plaintiff as specified in the contract. However, the suit says, the defendants did not have the ability to perform such a project as the tiny home was never completed or delivered the order.
The plaintiff alleges the defendants failed to fulfill its obligations under the contract, received and retained monetary benefit at Yambupah's expense and failed to return the monies paid for the construction of the tiny home.
Yambupah seeks trial by jury, damages of $44,000, punitive damages, interest and attorney fees. He is represented by attorneys Lauren Jones, Kathleen Gallagher and Tanya Harris of Gallagher Jones LLP in West Sacramento, California.
