Women's clothing company accuses Spanx of copyright infringement

LOS ANGELES — A Los Angeles women's clothing company is suing a manufacturer of undergarment clothing, alleging trade dress infringement and unfair competition.

R and A Synergy LLC filed a complaint Dec. 21 in U.S. District Court for the Central District of California Western Division against Spanx Inc., alleging violation of the Lanham Act.

According to the complaint, on Feb. 20, 2009, R and A Synergy filed a trademark application for the mark Sleevey Wonders and began filing a series of utility and designs patents covering certain under sleeve styles. The suit says the plaintiff had become the sole owner of the product until Spanx came out with a product that was sold under the brand Sheer Fashion that is nearly identical in appearance to Sleevey Wonders. 

The plaintiff alleges Spanx intentionally copied, reproduced, printed, displayed, offered for sale, and sold products that featured unlicensed copies of a copyrighted work.

R and A Synergy seeks trial by jury, damages, pre- and post-judgment interest, costs associated with prosecution and all further relief the court deems just. It is represented by attorney Jennifer H. Hamilton of Avyno Law PC in Encino.
